An ongoing lawsuit filed by a group of Nevada gamblers against the KED Casino in New Jersey is yet another legal hurdle the project is facing. The KED Casino is a planned casino resort in New Jersey that is owned and operated by a nonprofit organization, the KED Project. The KED Project was founded by a group of investors, but the lawsuit filed by the gamblers seeks to get the casinos license revoked by the state. The lawsuit argues that the KED Project is too closely associated with the casino in New Jersey, which the gamblers allege is illegal.
The KED Project, a joint venture between the Asian Gaming Research Group (AGRG) and the Global Gaming Research Group (GGRG), is operating a baccarat-based online poker room, and has been working on setting up an online pai gow (“BINGO”) room.
One of the more high-profile gambling-related cases in recent years was the 2013 decision by the Supreme Court of New Jersey to strike down the state’s sports betting law. The Kingsway Entertainment District’s arena center proposal seems to be facing additional legal challenges. The Minnow Lake Restoration Group, a non-profit organization, expressed its displeasure with Sudbury’s city council’s decision to construct the planned entertainment complex in KED this week. The organization has petitioned Ontario’s divisional court for a judicial review of the judgment.
The Kingsway Entertainment District proposal has been a hot topic of debate for more than three years. The planned proposal calls for the construction of a new municipal arena, a hotel, and a casino property in the Kingsway District’s east end. Following the resolution of prior problems, a new one has arisen.
More stumbling blocks
Eric Gillespie, a lawyer for the Minnow Lake Restoration Group, said that the court review is in line with the city council’s decision to go forward with the project last month. According to him, there are certain facts that were not addressed, and that these information have the potential to significantly alter people’s perceptions of the topic. And he thinks that some members wanted to take the idea forward during the meeting last month.
Before rendering a judgment, a judicial review examines whether legal criteria have been fulfilled, which Mr. Gillespie claims did not occur in this instance. If the court decides that all criteria were not fulfilled, the case will be referred back to the municipal council, according to the lawyer. According to him, putting all of the factors on the table for debate may result in a different choice outcome.
One of the major issues in the application, according to the non-profit organization’s counsel, was the fairness of the city’s decision-making process. He went on to say that the public had similar worries, but that they had gone unaddressed, implying that the motion is moving ahead despite a lot of unsolved issues.
Mr. Gillespie pointed out that although judicial reviews are not frequent in court, they have been done previously. He said that the group’s client agrees, and that there are valid grounds to raise the concerns about why the application is going ahead at this time. The city, on the other hand, has said that it is unable to comment on the issue at this time.
KED News from the Past
Patrick Crowe, a vocal opponent of the KED project, previously filed an online petition to include a vote on the proposal in a referendum in 2022. Mr. Crowe wants to know whether the KED project should go forward or if the downtown Sudbury Community Arena should be renovated. More than 700 people have signed the petition, expressing their desire to see the ancient arena restored.
However, a week after the online petition went viral, Greater Sudbury Ward 5 councilor Robert Kirwan said that the petition had no influence on the municipal council’s decision. According to him, there is a little possibility that the petition will be put to a vote. Furthermore, as he put it, an issue only goes to a referendum if the council is having difficulty agreeing on a topic, which is not the case here.
